These Terms and Conditions are in conjunction with House Rules.

Please read the following Terms and Conditions: 1.0 Short Term Rental Policies This Rental Agreement (hereinafter: the "Agreement") is a legally binding agreement between the Property Owner (hereinafter referred to as the "Owner") and the Guest, collectively referred to as the "Parties". The agreement becomes effective on the date the guest receives a copy via email or message and completes the booking process or receives a link to the website via invoice . A copy may be sent to the email address nominated in the Check in Form. By completing the booking process and proceeding with payment, the Guest agrees to the following terms and conditions. The Parties agree to the following terms: Booking Terms The Owner revises these Terms & Conditions from time to time by updating the website. The revised terms will take effect from the date they are posted. Should the property be sold, withdrawn for letting or become unavailable for another reason prior to this reservation commencing the Owner will cancel the booking resulting in a refund of fees paid. Please read these conditions carefully. The Guest acknowledges and agrees that these conditions apply and extend to any person (also referred to as ‘Guest’) occupying or visiting the property, and/or using the facilities with invitation of or with the authority of the guest. Payment, Charges And Booking Accommodation Charges must be paid by credit card before occupancy commences. An invoice will be issued to the email address on file and must be paid within 14 days prior to arrival. Occupancy starts and finishes on the dates shown on the invoice or booking confirmation. The Guest will be liable for payment of any charges incurred by any Guest together with all replacements and necessary costs for any damage or loss to the property and its contents caused by any guest. There is no refund for early departure. Upon paying the initial accommodation invoice booking, the guest’s payment method is stored on file through Stripe. If there are additional charges incurred at the discretion of the Owner, the guest will be notified via email or message outlining the charges. These charges will then be charged to the credit card on file and a paid invoice sent. Additional Charges: Excessive pet hair inside or if Pets are left home alone - $200.00 fee + Damages (if pet left alone termination may occur without refund). Strictly NO Parties or gatherings - $500 fee + Immediate termination of stay. Smoking Fee - $200.00 + Damages. BBQ cleaning fee of up to $100.00 will apply if it is left unreasonably dirty and the cleaner is required to clean it. Other Damages - as determined reasonable by the Owner and/or as supplied in an invoice. If an insurance claim is filed by the Owner, the Guest will be charged a deduction up to a maximum of $1000.00 for each claim. The Property must be left clean and tidy at the end of your reservation. Additional charges will be incurred if extra cleaning of the Property is required. The cost to clean the Property or repair damage to or reinstate the Property including couches and carpets, will be charged to the credit card(s) provided. It is a condition of occupancy that on departure all rubbish be removed, and the dishes washed and returned to their original place, with the property left in a tidy manner. Failure to do so could result in a cleaning charge being automatically charged to the credit card provided. Any non-emergency call outs, outside of office hours will incur a $50.00 call out fee. The Guest authorises the Owner to charge any credit card for any loss, damage or monetary contribution for which any Guest is liable under this document or otherwise. All costs due to foreign currency fluctuations when making or cancelling a booking will be borne by the guest. There are no refunds for any breakdowns of any electrical items or equipment, loss of electricity outside of the Owners control or as such. Occupancy And Conduct The property must not be used for any unlawful purpose. Guests must only park cars in the designated areas. The Property is set up with a ‘starter kit; and serviced mid-stay (based on an 14 night plus reservation – property dependant). The property is a residential premise within the Hervey Bay community. The Guest will not use the property for any illegal or commercial activities, including but not limited to sub-leasing the property or allowing more guests to stay than the maximum number agreed upon with the Owner. The property is to be used strictly as a residential premise by the guest(s) and the number of occupants nominated on the Guest Registration Form and not for any other purposes or by any greater number of occupants. The use of the Property for functions, parties or other like gatherings is STRICTLY PROHIBITED. The use of the property for such events or other than as a residential premise will result in the termination of your reservation of the Property, your removal from the Property and other costs or expenses being debited to the credit card(s) provided. The Owner is not liable for any damage or loss of property that a Guest may sustain while on the property. The rules and regulation of the property and any reasonable direction of the Owner must be complied with. The property must be vacated if after receiving a warning, any guest fails to comply. On departure all rubbish be removed, and the dishes washed and returned to their original place, with the property left in a tidy manner. The Guest(s) and all other occupants and visitors of the Property will not create or permit any noise or other nuisance to occur within or emanate from the Property. Failure to comply with the creation or occurrence of noise or other nuisance in or from the Property, may result in the termination of your reservation of the property and your removal from the Property. The Property is smoke free dwelling and must be kept clean and tidy and free of litter (including cigarette butts) at all times. Access And Liability The Owner may inspect the property at any time with reasonable notice and at any time without notice if the Owner is of the opinion that there has been a breach of these conditions. The Guest must allow the Owner or their authorized representative, including workmen, access to the property with reasonable notice during their stay, except in emergencies or situations where immediate access is necessary to resolve a problem, and the Guest cannot be contacted in time. In such cases, the Owner reserves the right to enter the property without prior notice to the Guest The Owner is not responsible for any mis-description of the property. No responsibility is taken for disturbances or inconveniences caused by building and other works. If the occupancy ends or is terminated, the Guest must immediately vacate the property. The Owner is authorised to do whatever is required to enforce the eviction of any Guest and removal of Guests property. The Owner recommends the Guest purchases travel insurance to cover any unforeseen circumstances. Cancellation Policy The Owner adopts the following practice when dealing with cancellation of a Holiday booking. Please note that all standard terms and conditions apply to all bookings regardless of government or council initiated restrictions to COVID-19 including, but not limited to, border closures. Cancellation 14 days prior to occupancy date: Free Cancellation Cancellation within 14 days: Full Occupancy Charge with no cancellation. Change of Date: The guest may request a change of date inside the cancellation period but it is at the discretion of the Owner if it is accepted. Pet Policy The Property is Pet Friendly and welcomes well-behaved and trained pets by prior arrangement. Pets are required to be vaccinated and have a current flea treatment. Pets are not permitted to be left alone at the property. Pets should have their own bedding brought and sleep either outside or on tiled flooring inside. Pets are not allowed on furniture, in bedrooms, or on beds. Guests are responsible for any damage caused by their pets, including cleaning up dog hair, waste, or excessive digging. Failure to report pet-related damage may result in damage charges. Dog-friendly beaches are available at designated locations. Please wash your dog after beach outings. Dispose of all pet waste properly. Failure to do so may result in a charge. Maximum of 2 dogs on the property at any time. Other pets are at the discretion of the Owner. Prior approval is required. Communication As a Guest, you opt in to receiving marketing communications from us by email from time to time. You may opt out at any time Additional House Rules Please note that any additional policies relating to rates and fees, check-in/out times, cancellations, minimum stays, smoking, pets, maximum guests allowed, children and age, security deposits, and other related matters will be governed by the House rules or the Reservation policies provided by the Owner, and may not be fully included in this Agreement. Noted House Rules: Check in 3pm onwards and Check out before 10am Max Guests of 6 including children. Photo ID must match booking information. No Smoking. No Bookings longer than 28 days. Pets are required to be vaccinated and have a current flea treatment. Pets are not permitted to be left alone at the property. If immediate termination occurs, there will be no refund. 2.0 House Manual. Hi, my name is Christina and I will be your host during your stay. I am sure you will have a very enjoyable stay. The details below will help you make the most of your stay. Please make yourself comfortable and enjoy our wonderful old house as much as we do. Pets: I welcome pets but please ensure you are a responsible dog owner to ensure I can remain pet friendly. Please clean up your animal poo and dispose of it in the bin. Please ensure your animal is not left alone at any time on the property. External Camera: There is an external camera facing the front gates. This monitors guest numbers, unwanted noise, vehicles and security. Check in: Keys: there is a spare key on a lanyard inside the house for your use. Parking: There is parking in the driveway behind the gates and to the back of the property. If you are unable to access the driveway due to the slight ramp, there is plenty of street parking available. TV: To operate the TV, turn the TV on with the TV remote. Daybed into a Queen: please slide the the bed frame above the drawers very slowly. Once it is all the way out then pull the top mattress onto it. Take away: There are a few takeaways in town - Blaze burgers is the closest fish and chip/buger place and the menu is in the pantry. There are more restaurants across the road and down towards the pier. Spare items: There are towels, pillows and blankets in the bedroom cabinets or under the day bed available for use. If you use them, please leave them out when you depart so we can clean them. The WIFI: I don’t advertise wifi as it’s unreliable with Telstra. The wifi password is on the fridge but please note it may not work. Windows: Please do not open windows and leave small children around them. The house is very old so please be mindful that the paint/wood does swell and it may be difficult to open them. Check out: Checkout Time: Please depart by 10am so our cleaner can prepare the house for our next set of guests. Linen: Please leave the bed linen as is on the bed. Towels can be left on the bathroom floor. Key: The key and the spare one can be left on the dining table and the front door pulled shut when you leave. Please be mindful that the door does shut and will lock you out so always have your keys on you if you leave the house (even for the rubbish!). Please shut and lock all other windows and doors when you depart. Dishes: Please clean all of your dishes and put them away. Rubbish: Please empty the bins and dispose of your rubbish into the large council green bin. This is located in the driveway. Left-over food or drink: Please dispose of your left over food and drink. Please don’t leave them in the fridge as they are unable to be used.
